The Montana Commissioner of Securities and Insurance is cracking down on unfair trade practices in the state’s health insurance market. A new advisory from Commissioner James Brown is putting health insurance companies on notice: don’t block or limit access to Medicare Advantage plans for Montanans who qualify.

Protecting Montanans From Unfair Insurance Tactics

Commissioner Brown says the purpose of this advisory is simple, to protect Montana consumers. His office has noticed certain companies trying to manipulate the health insurance market, especially when it comes to Medicare-eligible residents. Some of those tactics include limiting or making it harder for people to sign up for plans, which the state says is both unfair and potentially illegal.

Montana Law Cracks Down on Deceptive Insurance Practices

Under Montana law, it’s illegal for any insurance company to engage in unfair or deceptive business practices. That includes removing access to products, restricting competition, or using sneaky methods to steer customers away from certain plans. The law gives the Commissioner the power to step in whenever something looks deceptive, even if the tactic isn’t specifically spelled out in state code.

Reports Reveal Barriers to Medicare Advantage Access in Montana

According to the memo, the Commissioner’s office has heard reports that some insurance carriers offering Medicare Advantage plans have been making it harder for Montanans to get the coverage they want. These actions reportedly include things like removing enrollment forms from websites, discouraging agents from selling certain plans, or cutting off agent commissions partway through the plan year.

State Promises to Protect Medicare Access and Hold Insurers Accountable

For Montana’s Medicare eligible residents, this move is meant to make sure they have full and fair access to every health insurance option available without interference or manipulation. The Commissioner’s message is clear: if a company is caught restricting access or mistreating consumers, the state won’t hesitate to take action.
