A Billings man, Dustin James Massey, 40, was sentenced to 20 years in federal prison followed by five years of supervised release for possession with intent to distribute methamphetamine, fentanyl, and cocaine.

The sentencing was announced by U.S. Attorney Kurt Alme and handed down by U.S. District Judge Susan P. Watters.

Prior Convictions and Ongoing Supervision

Court documents revealed that Massey was already under federal supervision due to a prior conviction for possession with intent to distribute methamphetamine. Authorities had received information that Massey was actively selling drugs in Billings and was known to possess firearms.

Probation Search Turns Violent

On September 21, 2023, United States Probation officers, accompanied by agents from the Montana Division of Criminal Investigation (DCI), attempted a probation search at Massey’s residence. After Massey failed to respond to officers’ announcements, law enforcement breached the door. Massey responded by firing at officers, prompting them to return fire and ultimately shoot Massey. He was disarmed, and officers recovered a Sig Sauer pistol with an extended magazine.

Significant Drug and Firearm Seizure

Following the incident, agents executed a search warrant at Massey’s residence. They seized approximately four pounds of methamphetamine, over 12,000 fentanyl pills, and 49.4 grams of cocaine. In addition to the drugs, three firearms were recovered: a Sig Sauer P320 pistol, a Taurus G3 pistol, and a North American Arms .22 caliber revolver.

Prosecution and Investigation

Assistant U.S. Attorney Julie Patten prosecuted the case. The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Montana DCI.
